We Make Moments – Custom Songs

By purchasing, commissioning, or using any services from We Make Moments (“Company,” “we,” “us,” or “our”), you (“Client,” “you”) agree to the following Terms & Conditions.

1. Services Provided

We Make Moments creates custom, personalized songs based on information provided by the client. These songs may include vocals, lyrics, music production, and optional add-ons as described at the time of purchase.

All songs are created as artistic interpretations, not exact representations of real events or people.

2. Client Responsibilities

You agree to:

  • Provide accurate, appropriate, and lawful information for your custom song

  • Review all details carefully before final submission

  • Respond in a timely manner when feedback or clarification is requested

We are not responsible for delays caused by incomplete or late responses.

3. Revisions Policy

  • Each order includes [insert number, e.g., one (1)] revision unless otherwise stated

  • Revisions are limited to minor lyric or vocal adjustments

  • Major changes (theme, story direction, mood, or re-recording large portions) may incur an additional fee

Revisions must be requested within [insert timeframe, e.g., 7 days] of delivery.

4. Turnaround Time

Estimated delivery times are provided at checkout and may vary based on:

  • Order volume

  • Complexity of the song

  • Client response time

Delivery dates are estimates, not guarantees. We do our best to meet timelines but are not liable for delays beyond our control.

5. Payments & Refunds

  • All payments are due upfront

  • Due to the custom and personalized nature of our services, ALL SALES ARE FINAL

  • No refunds will be issued once production has begun, please see our Return and Refund Policy.

If we are unable to complete your order for any reason, a refund or credit will be issued at our discretion.

6. Intellectual Property & Usage Rights

  • We Make Moments retains full ownership of the music composition, lyrics, and master recordings unless otherwise agreed in writing

  • Clients receive a non-exclusive, non-transferable license to use the song for personal use only

 

Personal use includes:

  • Gifts

  • Personal social media posts (credit encouraged)

  • Private events

Commercial use (ads, monetized content, resale, streaming platforms, business branding, etc.) requires a separate licensing agreement.

7. Prohibited Content

We reserve the right to refuse or cancel orders that include:

  • Hate speech or discrimination

  • Explicit sexual content involving minors

  • Illegal activity

  • Content that conflicts with our brand values

If an order is refused before production begins, a refund will be issued.

8. Artistic Discretion

By purchasing, you acknowledge:

  • Music is subjective

  • Final creative decisions (melody, vocal style, phrasing, arrangement) remain with We Make Moments

  • Minor differences from expectations do not constitute grounds for a refund

9. Limitation of Liability

We Make Moments shall not be liable for:

  • Emotional reactions or interpretations of the song

  • Indirect or consequential damages

  • Misuse of the delivered content

Our maximum liability is limited to the amount paid for the service.

10. Privacy

Client information is used only to complete your order and will never be sold or shared with third parties, except as required by law.

11. Termination

We reserve the right to terminate service if these Terms & Conditions are violated. No refunds will be issued for terminated orders already in production.

12. Governing Law

These Terms & Conditions are governed by the laws of the United States, without regard to conflict of law principles.

​

13. Acceptance of Terms

By purchasing from We Make Moments, you confirm that you have read, understood, and agreed to these Terms & Conditions.
